SMS Terms and TCPA Consent

These SMS Terms govern your use of text messaging communications with Prime Harbor Insurance, LLC (“Prime Harbor,” “we,” “us,” or “our”). By providing your mobile phone number to Prime Harbor and consenting to receive text messages, you agree to these SMS Terms.
These SMS Terms work together with our Privacy Policy and Terms of Service. If you have not read those documents, we encourage you to do so before opting in to text communications.
ABOUT THIS PROGRAM
Prime Harbor Insurance operates a text messaging program to communicate with consumers and customers about insurance quotes, applications, policies, claims, service requests, marketing offers, and other related matters.
Our text messaging program complies with the Telephone Consumer Protection Act (TCPA), the rules of the Federal Communications Commission (FCC), CTIA Messaging Principles and Best Practices, mobile carrier requirements, and applicable state laws.
HOW YOU OPT IN
You may opt in to receive text messages from Prime Harbor in any of the following ways:
• Submitting a quote request, application, contact form, quiz, or other intake form on primeharborinsurance.com that includes a clear consent disclosure and a checkbox or other affirmative action
• Texting a keyword or short code published by Prime Harbor
• Verbally consenting during a recorded phone call with a Prime Harbor representative
• Providing written consent in person or via email
• Updating your communication preferences in any Prime Harbor portal or account where applicable
When you opt in, you confirm that:
• You are the subscriber or authorized user of the mobile phone number provided
• You are at least 18 years of age, or the age of majority in your state
• The mobile phone number you provided is accurate
• You consent to receive text messages from Prime Harbor at that number
• You understand message and data rates may apply
Your consent to receive text messages is not a condition of purchase of any insurance product or service.
TYPES OF MESSAGES YOU MAY RECEIVE
Depending on your relationship with Prime Harbor and the consent you have provided, you may receive the following types of messages:
Transactional and Servicing Messages
• Quote follow-up and application status updates
• Appointment confirmations, reminders, and rescheduling
• Document delivery confirmations and signature requests
• Policy updates, renewal reminders, and lapse warnings
• Claims-related communications and updates
• Payment reminders and confirmations
• Customer service responses to your inquiries
• Two-factor authentication or verification codes where applicable
Marketing Messages
• New product or service announcements
• Cross-sell offers, including renters bundle reminders, life insurance reviews, and final expense information
• Promotional offers, discounts, and limited-time programs
• Educational insurance content and tips
• Newsletter updates and agency news
• Review requests and feedback surveys
You may opt out of marketing messages at any time while continuing to receive transactional and servicing messages required to deliver insurance services.
MESSAGE FREQUENCY
Message frequency varies based on your relationship with Prime Harbor and your engagement with our services. Typical patterns include:
• Active quote or application: Up to 5 messages per week during the active quote process
• Bound policyholders: 2 to 8 messages per month for routine servicing
• Marketing program subscribers: 2 to 4 marketing messages per month
• Renewal periods, claims, and policy events: Higher frequency as needed for time-sensitive matters
We do not send unsolicited marketing texts late at night or before reasonable morning hours, except for urgent service or claims matters.
MESSAGE AND DATA RATES
Message and data rates may apply. Prime Harbor does not charge a fee for sending text messages, but your mobile carrier may charge fees for sending and receiving text messages depending on your wireless plan. Check with your carrier for details.
You are solely responsible for any charges from your mobile carrier related to text messages sent to or received from Prime Harbor.
HOW TO OPT OUT
You can opt out of text messages at any time, free of charge, in any of the following ways:
Reply STOP
Reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT to any text message from Prime Harbor. We will send a one-time confirmation message and will not send further marketing or promotional texts to that number.
Send an email to info@primeharborinsurance.com with the subject line “STOP TEXT” and include the mobile number you wish to opt out.

Call 504-949-4760 during business hours and ask the representative to opt your number out of text communications.
Account Preferences
Update your communication preferences through any Prime Harbor portal or account where available.
EFFECT OF OPTING OUT
After you opt out:
• You will not receive marketing or promotional text messages from Prime Harbor
• You may still receive transactional or servicing messages required to deliver insurance services, including time-sensitive policy or claims communications, where legally permitted
• You may still be contacted by phone or email if you have not also opted out of those channels
• To opt out of all communications, contact us using the methods above and specify which channels you wish to opt out of
To opt back in to text messages after opting out, text START or SUBSCRIBE to any Prime Harbor short code or long code, or contact us using the methods above.

SUPPORTED CARRIERS
Our text messaging program is compatible with major United States wireless carriers, including AT&T, Verizon, T-Mobile, US Cellular, and most regional and prepaid carriers.
Wireless carriers are not liable for delayed or undelivered messages. Prime Harbor is not responsible for any messages that cannot be delivered due to carrier issues, signal availability, device compatibility, or other technical reasons outside our control.
USE OF AUTOMATED TECHNOLOGY
By providing your mobile phone number and consenting to text messages, you authorize Prime Harbor to send messages using automated dialing technology, prerecorded messages, application-to-person (A2P) messaging platforms, and similar technologies.
Your consent to receive automated text messages is not a condition of purchasing any insurance product or service. You can decline automated messages and still request quotes, purchase policies, and receive servicing through other communication channels including phone calls and email.
PHONE CALLS AND VOICE MESSAGES
In addition to text messages, by providing your phone number you authorize Prime Harbor to contact you by phone calls, voicemail, voicemail drops, and automated voice tools regarding insurance matters. This authorization includes:
• Calls placed using automated dialing technology
• Calls using prerecorded messages or artificial voice technology
• Voicemail drops and ringless voicemail
• Automated voice and conversational tools
• Live calls from licensed Prime Harbor representatives
All phone calls with Prime Harbor may be recorded for quality assurance, training, documentation, compliance, and business purposes. By continuing a call after notice of recording, you consent to the recording.
You can opt out of marketing calls at any time by notifying us through any of the methods in the How to Opt Out section.
PRIVACY
Information you submit when opting in to text messages, including your mobile phone number and any content of messages you send to us, is handled according to our Privacy Policy.
We do not sell mobile phone numbers or text message content. We use this information only for the purposes of operating the text messaging program, providing insurance services, and complying with applicable law.

COMPLIANCE WITH FEDERAL AND STATE LAW
Our text messaging program is designed to comply with:
• Telephone Consumer Protection Act (TCPA): Federal law governing automated calls and text messages
• CAN-SPAM Act: Federal law governing commercial electronic messages, where applicable
• Federal Communications Commission (FCC) rules: Regulatory framework for telecommunications
• CTIA Messaging Principles and Best Practices: Industry standards for mobile messaging
• State telemarketing and consumer protection laws: Including those of Louisiana and other states where we operate
• Mobile carrier requirements: Contractual and policy requirements from wireless carriers
We do not send text messages to numbers on the National Do Not Call Registry without an established business relationship or specific consent, and we honor opt-out requests promptly as required by law.
DISCLAIMER OF WARRANTIES
The text messaging program is provided “as is” and “as available.” Prime Harbor does not warrant that:
• Text messages will be delivered, received, or read at any specific time
• The text messaging program will be uninterrupted, error-free, or secure
• Any specific message will reach you due to factors outside our control, including carrier issues, signal availability, device problems, or platform failures
To the fullest extent permitted by law, Prime Harbor disclaims all warranties related to the text messaging program.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, Prime Harbor and its representatives, employees, contractors, and service providers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your participation in or use of the text messaging program, including damages arising from undelivered messages, delayed messages, unauthorized access to your device, or third-party platform failures.
This limitation applies regardless of the legal theory of liability and to the fullest extent permitted by law.
MODIFICATIONS TO THIS PROGRAM
Prime Harbor reserves the right to modify, update, suspend, or discontinue the text messaging program at any time, with or without notice. We may also modify these SMS Terms from time to time to reflect changes in our practices, technologies, legal requirements, or business operations.
When we update these SMS Terms, we will revise the “Last Updated” date displayed with these SMS Terms. Material changes will be communicated through reasonable notice. Your continued participation in the text messaging program after changes are posted constitutes your acceptance of the updated SMS Terms.
SHARING AND RESELLING PROHIBITED
Prime Harbor does not share, sell, or transfer your mobile phone number to third parties for their independent marketing purposes. Service providers and platform vendors may process mobile phone numbers on our behalf under contractual data protection obligations to deliver our text messaging program. LOST OR STOLEN DEVICES
If your mobile device is lost or stolen, contact your mobile carrier immediately and notify Prime Harbor as soon as possible at 504-949-4760 or info@primeharborinsurance.com. We will pause text communications to that number while you arrange a replacement and update your contact information.
NUMBER CHANGES
If you change your mobile phone number or transfer your number to a different person, notify Prime Harbor immediately so we can update our records. You are responsible for ensuring that mobile phone numbers on file with us are current.
If we send a text message to a number you have provided that is later transferred to another person, the new owner of that number may opt out by replying STOP, but we cannot guarantee that prior messages have not been received by them. To minimize this risk, update us promptly when your number changes.

SAMPLE CONSENT LANGUAGE
The following consent language is used on Prime Harbor quote forms, applications, and intake tools to obtain your express consent to text messaging:
“By submitting this form, I authorize Prime Harbor Insurance, LLC to contact me by phone, text message, email, voicemail, and other methods at the number and email provided regarding insurance products and services, even if my number is on a Do Not Call list. I understand that consent is not a condition of purchase, that automated dialing technology and prerecorded messages may be used, and that message and data rates may apply. I can opt out of text messages at any time by replying STOP. See Privacy Policy and SMS Terms for details.”
This language may be presented as part of a checkbox, button click, or other affirmative action that documents your consent.
