This page explains your rights to opt out of the “sale” or “sharing” of your personal information under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), and similar consumer privacy laws in other states. Prime Harbor Insurance, LLC (“Prime Harbor,” “we,” “us,” or “our”) respects your privacy rights and provides this page so you can exercise your opt-out rights easily.

Our Position on Selling Personal Information

Prime Harbor Insurance does not sell your personal information for monetary consideration.

We do not exchange your personal information for money with data brokers, third-party advertisers, or any other party.

However, certain online advertising and analytics activities may meet the broader definition of “sale” or “sharing” under the CCPA, the CPRA, and similar state privacy laws. These laws define “sale” and “sharing” to include disclosing personal information to third parties for cross-context behavioral advertising, even if no money changes hands.

Examples of activities that may be considered “sharing” under these laws include:

– Use of advertising cookies, pixels, and tags such as Meta Pixel, Google Ads tags, and similar technologies
– Use of analytics tools that may transmit identifiers to advertising platforms
– Retargeting and remarketing campaigns across websites and platforms
– Audience-building activities that use online identifiers tied to your browsing behavior

Out of an abundance of caution and to give you full control, we provide the opt-out rights described below regardless of whether a specific activity legally qualifies as a “sale” or “sharing” of personal information.

Your Right to Opt Out

You have the right to direct Prime Harbor not to sell or share your personal information for cross-context behavioral advertising. You may exercise this right at any time, free of charge, and without penalty.

When you exercise your opt-out right, we will:

– Stop sharing your personal information with advertising partners for cross-context behavioral advertising
– Honor your opt-out preference for at least twelve (12) months
– Not require you to create an account to exercise your right
– Not discriminate against you for exercising your right
– Provide opt-out across all channels we reasonably can, including website tracking technologies

Opting out does not prevent Prime Harbor from contacting you about your insurance request, an active policy, a claim, or other servicing matters. It also does not prevent essential website functions such as security, fraud prevention, and basic operation.

How to Opt Out

You can opt out of the sale or sharing of your personal information through any of the following methods:

A. Cookie Preference Center

When you visit our website, you will see a cookie consent banner that lets you set your preferences. You can:

– Click “Reject All” to decline non-essential cookies and tracking technologies
– Click “Manage Preferences” to choose specific categories to allow or block
– Reopen the cookie preference center at any time using the “Cookie Preferences” or “Privacy Choices” link in the website footer

B. Global Privacy Control (GPC) Signal

We honor the Global Privacy Control (GPC) browser signal as a valid opt-out request, as required under California regulations and recognized by other state privacy laws.

If your browser or browser extension transmits a GPC signal, we will treat that signal as an opt-out of the sale and sharing of personal information for that browser and device. To enable GPC, you can:

– Use a browser that supports GPC natively, such as Brave or Firefox with appropriate settings
– Install a GPC-enabled browser extension, such as Privacy Badger or DuckDuckGo Privacy Essentials

GPC opt-outs are limited to the specific browser and device on which the signal is enabled. To opt out across all devices and browsers, also submit a request through one of the methods below.

C. Email Request

Send an email to privacy@primeharborinsurance.com with the subject line “Do Not Sell or Share My Personal Information” and include:

– Your full name
– Your email address
– Your phone number, if you have communicated with us by phone
– Your state of residence
– A brief statement that you wish to opt out of the sale and sharing of your personal information

D. Phone Request

Call us at 504-949-4760 during regular business hours and tell the representative you wish to opt out of the sale and sharing of your personal information. We will record your request and confirm in writing.

E. Mail Request

Authorized Agents

You may designate an authorized agent to submit a Do Not Sell or Share request on your behalf. Authorized agent requests must include:

– Written, signed authorization from you naming the agent
– Verification of the agent’s identity
– Verification of your identity, unless we have a pre-existing relationship that allows us to verify identity through other means

We may deny authorized agent requests that do not meet these requirements.

Verification of Your Identity

To protect your privacy and prevent fraud, we may need to verify your identity before processing your opt-out request. We will request only information reasonably necessary to verify identity, which may include:

– Confirming the email address or phone number associated with our records
– Asking questions about your prior interactions with Prime Harbor
– Requesting a signed declaration where required by law

We do not require sensitive identifiers such as Social Security Number or driver’s license number to process opt-out requests. If we cannot verify your identity, we will inform you and explain what additional information may be needed.

Sensitive Personal Information

Under the CPRA, you have the right to limit our use and disclosure of “sensitive personal information” to purposes necessary to provide the services you have requested.

Prime Harbor Insurance does not use or disclose sensitive personal information for purposes other than:

– Providing the insurance products and services you request
– Servicing active policies and claims
– Responding to your inquiries and communications
– Maintaining the quality and security of our services
– Detecting and preventing security incidents and fraud
– Complying with legal obligations and carrier requirements
– Performing services on behalf of Prime Harbor through service providers under contractual data protection obligations

Because we do not use sensitive personal information for purposes that would trigger the additional CPRA opt-out, no separate “Limit the Use of My Sensitive Personal Information” link is required. If you have specific concerns, contact privacy@primeharborinsurance.com.

Categories of Personal Information We May Share

The following categories of personal information may be shared in ways that the CCPA/CPRA broadly defines as “sale” or “sharing” through advertising and analytics technologies:

– Identifiers: Online identifiers, IP address, cookie identifiers, advertising identifiers
– Internet Activity: Browsing history on our website, interaction with content, referring sources, page views, click patterns
– Geolocation Data: General location inferred from IP address or device signals
– Inferences: Audience-segment inferences drawn from your interactions with our website

We do not knowingly share the following categories through advertising or analytics technologies:

– Social Security Number
– Driver’s license number
– Financial account or payment card number
– Precise geolocation
– Health information
– Insurance application content beyond general traffic measurement
– Communications content with us

Categories of Third Parties

The categories of third parties to whom we may disclose personal information for purposes that may constitute “sale” or “sharing” include:

– Advertising platforms such as Google Ads and Meta (Facebook and Instagram) advertising tools
– Analytics providers such as Google Analytics
– Tag management and conversion-tracking platforms
– Marketing technology providers and CRM platforms
– Audience-segmentation and remarketing platforms

Other State Privacy Rights

If you are a resident of another state with comprehensive privacy laws, including Colorado, Connecticut, Utah, Virginia, Texas, Oregon, Montana, Iowa, Indiana, Tennessee, Delaware, New Jersey, Minnesota, Maryland, Nebraska, New Hampshire, Kentucky, Rhode Island, or any other state with similar privacy legislation, you may have similar rights to opt out of targeted advertising, the sale of personal information, or both.

You can exercise these rights using the same methods described in Section 3 above. Specify your state of residence in your request so we can process it under the correct legal framework.

Children Under 16

Prime Harbor Insurance does not knowingly sell or share the personal information of consumers under 16 years of age. If you believe we have inadvertently collected personal information from a consumer under 16, contact privacy@primeharborinsurance.com immediately and we will investigate and address the issue.

For consumers between 13 and 16, opt-in consent is required before any sale or sharing of personal information. For consumers under 13, parental consent is required.

No Discrimination

Prime Harbor will not discriminate against you for exercising your privacy rights, including the right to opt out of the sale or sharing of personal information. Specifically, we will not:

– Deny you insurance products or services
– Charge you different prices or rates for insurance products or services
– Provide you a different level or quality of insurance products or services
– Threaten or impose any penalty in connection with your exercise of privacy rights

Different rates may apply based on actuarial, underwriting, and risk-based factors permitted under insurance law, but those rates are not affected by your exercise of privacy rights.

Response Timeframes

We will:

– Acknowledge your opt-out request within ten (10) business days of receipt
– Process and confirm your opt-out within fifteen (15) business days, as required under California law
– Honor your opt-out preference for at least twelve (12) months before requesting renewed consent

If we cannot process your request within these timeframes due to verification or other legitimate reasons, we will explain the delay and provide an updated timeline.

Effect of Opting Out

After you opt out:

– We will stop sharing your personal information with advertising partners for cross-context behavioral advertising
– You may continue to see advertisements from Prime Harbor on third-party platforms based on general targeting that does not rely on your personal information
– You may continue to see general (non-personalized) advertisements from third parties
– Essential website functions, including security, fraud prevention, and core operation, will continue
– We will continue to communicate with you about your insurance requests, policies, and claims as authorized

Opting out does not delete personal information we have already collected. To request deletion, see our Privacy Policy or submit a separate deletion request.

Cookie Categories and Controls

Our website uses several categories of cookies and tracking technologies. You can manage your preferences for each category through our cookie preference center:

– Strictly Necessary Cookies. Required for the website to function. Cannot be disabled.
– Functional Cookies. Enhance your experience by remembering preferences. Optional.
– Analytics Cookies. Help us understand how visitors use the website. Optional.

These tools are operated by third parties, not Prime Harbor. Their effectiveness depends on third-party compliance and may change over time.
